By accessing and using MakeCookbook ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
MakeCookbook is a subscription-based platform that allows users to create, organize, and export personalized cookbooks. The Service includes tools for recipe management, cookbook design, and PDF generation.
You must be at least 13 years old to use the Service. By using MakeCookbook, you represent and warrant that you meet this age requirement.
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You pay for your subscription in advance, for the billing period of the plan you choose, and it renews at the end of each period until you cancel. All payments are processed securely through Stripe. You may cancel your subscription at any time from your account settings, and your access will continue until the end of the period you have paid for.
We offer a 30-day money-back guarantee. If you are not happy with the Service for any reason, email us within 30 days of your first subscription payment and we will refund it in full. After that, refunds may be provided at our sole discretion. To ask for a refund, please contact us at support@makecookbook.com.
You retain all ownership rights to the content you create using the Service, including your recipes, photos, and cookbooks. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.
You are responsible for ensuring you have the right to use any content you upload, including recipes and images.
The Service, including its design, code, features, and branding, is owned by MakeCookbook and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
You may not use the Service:
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.
You may delete your account at any time: choose "Delete my account" in your account settings, or contact us. Your account closes straight away. For 14 days you can change your mind by signing in and choosing "Keep my account".
If you cancel your subscription, we keep your content for as long as your account exists. You may resubscribe to regain access, or download a copy of your data from your account settings. To have your content deleted, delete your account.
If you ask us to delete your account, we delete it, with your cookbooks, recipes and photos, within 30 days. If you have a subscription, we cancel it. We keep records of payments and print orders, as the law requires. Your name and address are removed from print orders. Cookbooks and recipes you made inside a team (called a Kitchen in the app) can stay with the team or be deleted with your account; we check with you first. Photos you added to a team with other members stay with that team. Copies of deleted data remain in our backups for up to 365 days, as our Privacy Policy describes.
We strive to maintain reliable service, but we do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, MakeCookbook shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless MakeCookbook and its owners from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Ohio.
